1. General Information

The website Azar available at azar.chat (hereinafter referred to as the “Service”, “Company”, “we”, “us”, “our”) is the web service that offers live video chat options including communication between users by means of audio and video channels and text messaging.

The Service provides its Users with a video chat web application which includes audio and video communication, text messaging, auto-translation, etc. on an absolutely free-of-charge basis (which means that the Users don’t have to pay for using the Service). The Company reserves the right to introduce any other services or options as part of the Service as deemed beneficial or necessary.

3. User Obligations

3.1. All Service Users fully and completely accept and agree to be bound by these Terms and Conditions. Users unwilling to be bound by these Terms and Conditions of Use are advised against accessing the Service.

Users affirm that all information provided to the Service is accurate, current, and truthful, and does not contain any misleading or dishonest details. Users agree not to solicit paid sexual relations or engage in any activity resembling prostitution with other Users. Users must refrain from any conduct that could implicate the Company’s civil or criminal liability in accordance with legal provisions related to pimping.

3.4. Compliance with Laws and Regulations

By using the Service Users agree to adhere to and abide by all applicable laws and regulations. They agree not to infringe upon the rights of any third party. Each User is solely responsible for fulfilling all necessary administrative, tax, and/or social obligations, arising from their use of the Service. 4. User Content

4.1. Each User bears sole responsibility for any content they make available or transmit within the Service (the "Content"), including but not limited to video, audio, text, or any other form of data. Users guarantee that they possess all necessary rights to post their Content, that their Content is lawful, does not infringe upon any third-party rights or legal provisions/regulations, and does not implicate any kind of liability for the Company.

By posting the Content in the mobile application and website, User hereby grants the Company a non-exclusive, fully paid, worldwide license to utilize, reproduce, publicly perform, and display this Content on the mobile application and website. This license includes, but is not limited to, distributing all or part of the mobile application and website through various media formats and channels.

The Company may and will monitor and moderate communication channels and the Content to ensure the provision of the Services as well as compliance with these Terms or any applicable laws.

4.2. The Users agree to not to publish or otherwise make available the Content on the Service that:

- is or may be deemed illegal, defamatory, libellous, immoral, misleading, deceptive, fraudulent, indecent, hateful, racially or religiously biassed, offensive, slanderous, obscene, pornographic, sexually explicit, or that encourages violations of local, state, national, or international laws;

- supports or promotes in any way discrimination based on various grounds and characteristics;

- can be used to abuse, harass, humiliate, or intimidate individuals or groups;

- infringes upon the intellectual property rights (such as copyright, patent, trademark, trade dress, trade secret) and publicity rights of third parties, as well as their right to privacy;

- showcases, promotes or encourages criminal activities, acts of violence or illegal use of weapons and dangerous objects, or facilitates the purchase of firearms or ammunition;

4.3. By uploading, posting, transmitting or sharing any Content the User warrants that:

- the User is the only individual depicted on the Content and that no other person is shown or included in the Content;

- the User holds the copyright or necessary rights to the Content;

- the Content does not contain third-party materials or visible trademarks without necessary permission;

- the Content does not contain child photos, images, or likenesses.

4.4. The Company is not liable for User’s use of the Service. The Company reserves the right to take legal measures against Users who violate these Terms and Conditions, as permitted by applicable laws.

5. Forbidden Conduct

5.1. The following types of activity are strictly prohibited when using the Service:

- engaging in any activity that deviates from the intended purpose of the Services;

- engaging into any unlawful or fraudulent activities including those jeopardizing the safety of others or infringing upon the rights or others;

- intimidating, harassing, or defaming any Users;

- violating public order as well as any applicable laws and regulations;

- soliciting money from any Users;

- disclosing personal or contact information;

- applying any hacking or hijacking hardware or software as well as engaging in activities aimed at harming, disrupting, obstructing, breaching, controlling, interfering with, or intercepting part or all of the Company’s or any third-party’s computer system, compromising its integrity or security;

- copying or utilizing, for any purpose, the concept, technology, or any other component of the Service;

- sending unsolicited emails or engaging in prospecting or commercial solicitation;

- manipulating any Content to improve the ranking of another site;

- using the Service to distribute information or links to third-party websites;

5.2. If a User breaches any provision of these Terms and Conditions or any violation of applicable laws and regulations, the Company reserves the right to take appropriate measures, including but not limited to:

- suspending access to the Service or deleting the Service account of any User involved in the breach or violation;

- removing any and all Content posted by the User on the Service;

- informing relevant authorities as well as initiating legal proceedings against the breacher as deemed necessary.

6. Company’s Liability

The Company takes every effort to provide the Service with diligence and in accordance with industry standards. However, the Users agree that the Company's obligation is one of due care and not of guaranteed results.

Although the Company takes every effort to provide safe and secure operation of the Service, including User data integrity and safety, Service accessibility and maintenance, there can be instances when User data can be lost or damaged. In these instances, the Company bears no responsibility for any loss, and the User is advised to maintain backup copies of their information. Additionally, the Company shall not be held liable if the Service becomes temporarily difficult or impossible to access due to circumstances beyond the Company’s control, force majeure, or disruptions in the telecommunications network.

The Company does not guarantee to Users that:

- the Service will be entirely free of errors, faults, or defects, although it is subject to continuous performance improvement;

- the Service will specifically meet the needs or expectations of any given User.

In any event, any liability incurred by the Company under these Terms and Conditions is expressly and solely limited to direct actual damages suffered by Users.

7. Intellectual Property

7.1. The systems, software, infrastructures, databases, and content (including text, images, graphics, music, logos, trademarks, databases, etc.) applied by the Company in the Service are protected by all applicable intellectual property rights or rights for the creators of databases. Any unauthorized use of all or part of these items including dismantling, decompilation, deciphering, extraction, copying, reproducing, representing, publishing without the Company’s authorization is strictly prohibited and may result in legal action.

7.2. By making available their Content on the Service the Users voluntarily and freely express their intention to contribute to the diversity of information contained therein. If applicable, Users grant the Company the right to use and reproduce their Content for promotional purposes on the Website. This authorization is granted for the duration of their registration. The Users may contact the Manager to withdraw their consent.

8. Advertisements and Third Party

8.1. The Company may apply advertising or promotional messages within the Service or in any communication means when contacting Users, in the way and under conditions determined solely by the Company.

8.2. The Service may contain links to Internet sites or mobile applications operated by third parties. The Company cannot be held responsible for the technical availability or unavailability of these third-party websites and applications as well as for the content, advertisements, products, services offered by or through these third-party websites and applications.

The Users bear sole responsibility when accessing and entering into any interaction with these third parties and must refer to the respective terms and conditions of use for these third-party services. The Company does not participate in any disputes with these third parties, particularly regarding the delivery of products and/or services, warranties, representations, or any other obligations to which these third parties may be subject.

9. Term and Cancellation of Service

The Users have the option to opt out of the Service by deleting their account in the account settings. This action will result in the automatic deletion of their account.

The Company reserves the right to close and delete any account that remains inactive for a continuous period of 365 (three hundred and sixty-five) days.

10. Dispute Resolution

Any disputes related to these Terms and Conditions shall be resolved through binding arbitration instead of litigation in a court (except for claims within the court's jurisdiction). All claims or disputes, regardless of their nature or the remedies sought, are subject to arbitration.

Each User agrees to absolve the Company, its affiliates, and other related parties of any liability and indemnify them against any loss or claims made by any third party arising from or related to the User’s use of the Service in violation of any provision or warranty of these Terms and Conditions.
